Ohio Revises Rule Governing Keg

Purchases To Aid Enforcement

For several years, colleges, universities, and community coalitions in the state of Ohio have been actively addressing the problem of underage drinking on college campuses.  Last August, the state’s Department of Public Safety (DPS) took another step in this effort when it revised a rule affecting the purchase of multiple beer kegs. 

Rule 68, or the “5 for 5” rule as it is popularly known, requires that anyone purchasing five or more kegs be registered with the beer distributor.  Five days before the purchase, the purchaser must submit a notarized affidavit stipulating that he or she is aware of and will comply with the state’s liquor laws, including those laws prohibiting the furnishing of alcohol to minors and intoxicated persons.  By signing the affidavit, the purchaser also consents to law enforcement monitoring of the planned event.  The distributor sends a copy of the affidavit to DPS that, in turn, notifies the local police department of the event’s location.
